Withdrawal & Cancellation Policy

(Distance-services in the European Union – Directive 2011/83/EU transposed in Latvian Consumer Rights Law)

This page explains how and when private consumers may cancel (withdraw from) a repair service contract concluded online with BOTSMIT, and the consequences of doing so. Business customers (B2B) have no statutory right of withdrawal.

1 Your 14-Day Right of Withdrawal (Cooling-Off)

1.1 You may withdraw from the service contract within 14 calendar days without giving any reason.
1.2 The withdrawal period begins on the day we e-mail the Order Confirmation after you submit the repair request form.

2 Exceptions – Loss of the Withdrawal Right

According to Article 16(c) of Directive 2011/83/EU, your right of withdrawal expires once:

  • you approve the repair quotation and expressly request us to start the repair, and
  • the service has been fully performed (device repaired and ready for dispatch).

If you cancel after approving the quotation but before work is completed, you must pay for the proportion of the service already rendered up to the moment of cancellation (Article 14 (3) CRD).

3 How to Exercise Your Right

To withdraw, you must notify us of your decision by an unequivocal statement before the 14-day period expires.
You may use the Model Withdrawal Form in Section 6, or simply e-mail us:

Body: “I hereby withdraw from my service contract [Order ID] concluded on [Date]. Name, Address, Signature (if on paper).”

You will receive an acknowledgement of receipt without delay (e-mail).

4 Return of Your Device

  • If your device is already at our service centre and no quotation has been approved, we will return it unrepaired.
  • Return shipping costs (€10) are payable by you; we deduct them from any refund.
  • You bear the risk of loss only if you choose your own carrier; otherwise BOTSMIT’s carrier terms apply.

5 Refunds

  • We reimburse all payments received from you within 14 days of receiving your withdrawal notice.
  • Refunds are issued using the same payment method you used, unless you expressly agree otherwise.
  • We may withhold the refund until (a) the Device has been collected by the carrier or (b) you provide proof of dispatch, whichever occurs first.
  • If you requested the service to begin during the withdrawal period and subsequently withdraw, we deduct a pro-rata amount for work already performed.
