1. Scope and Definitions

1.1. These General Terms and Conditions (“T&C”) apply to every distance-service contract between SIA 7Lines Solutions (trading as “BOTSMIT”, here-after “Seller”, “we”, “us”) and any consumer or business customer (“Customer”, “you”) for the inspection, repair, or refurbishment of robot vacuums, docking / base stations and related accessories (collectively “Device”).

1.2. Consumer means a natural person acting for purposes outside their trade, business or profession (Art 2(1) Dir 2011/83/EU). Business Customer or Entrepreneur means any person or entity acting in the exercise of a trade, business or profession.

1.3. Deviating conditions of the Customer do not apply unless explicitly agreed in writing by BOTSMIT.


2. Contract Formation & Order Process

2.1. Non-binding presentation. Service descriptions on botsmit.com are invitations to treat, not binding offers.

2.2. Online request. You complete the repair request form, accept these T&C and submit. This constitutes a binding offer.

2.3. Acknowledgement. We e-mail a confirmation of receipt and a prepaid Courier Label (€10 per leg) within 24 h.

2.4. Sending the Device. Ship the Device within 7 calendar days. The contract text (these T&C) is stored and sent to you in PDF with the acknowledgement.

2.5. Language. Contracts may be concluded in English, Latvian or any other language offered on the site.

2.6. Auto messages. You must ensure that e-mails from @botsmit.com pass any spam filters.


3. Diagnostic, Repair Authorisation & Additional Work

3.1. Free Diagnostic. Upon arrival the Device undergoes a technical inspection free of charge within 2 business days.

3.2. Quotation. We e-mail a detailed price quote valid for 14 days. No work starts without written customer approval.

  • Accept → we perform the work.
  • Decline or no reply → we return the Device unrepaired; you pay only return shipping (€10).

3.4. Additional defects. If latent issues emerge during repair, we request additional approval. If refused, we re-assemble the Device and charge only for work already performed.

3.5. Non-repairable devices. If no parts are available or repair is economically disproportionate, we inform you and return the Device unrepaired; you pay shipping only.

3.6. Data Back-up. Customer must back up data/maps before shipment; we are not liable for data loss.


4. Prices, Payment & VAT

4.1. All amounts are EUR inclusive of Latvian VAT (21 %). Shipping surcharges for XL base-stations are shown before checkout.

4.2. Payment methods: Stripe (cards), PayPal, SEPA bank transfer to Swedbank AS · IBAN: LV77HABA0551048205206 · BIC: HABALV22

4.3. Payment is due upon invoice issuance and must be received before return shipment. Late payments accrue 0.05 % interest per day.

4.4. For Business Customers outside Latvia but within the EU providing a valid EU VAT number, VAT may be zero-rated under the reverse-charge mechanism (Art 44, 196 VAT Directive).


5. Delivery, Shipping & Transport Risk

5.1. All shipments booked with BOTSMIT’s prepaid label travel under the standard carrier liability (DHL/DPD/FedEx, currently ~€10 per kg under the CMR Convention).

5.2. BOTSMIT bears the risk of loss or damage only up to that carrier limit and only while the parcel is in the carrier’s custody.

5.3. The Customer must pack the Device according to BOTSMIT’s Packaging Guide (UN3481 — lithium battery ≤ 30 % SoC, battery installed). BOTSMIT is not liable for damage resulting from inadequate packaging.

5.4. Packaging duties. Customer must follow our Packaging Guide (UN3481 — lithium battery ≤ 30 % SoC, battery installed). BOTSMIT is not liable for in-transit damage due to inadequate packaging.

5.5. The Customer may request—and pay for—additional declared-value insurance before shipping.

5.6. If the Customer ships via their own carrier, risk transfers on hand-over to that carrier (Art 20(2) Dir 2011/83/EU).


6. Right of Withdrawal (EU Consumers)

6.1. Cooling-off. Consumers may withdraw within 14 days of order confirmation and before approving the Quotation (Art 9 Dir 2011/83/EU).

6.2. Model form. See Appendix A.

6.3. Waiver. By approving the Quotation you request immediate performance and acknowledge that the right of withdrawal is lost once the repair is completed (Art 16(c) Dir 2011/83/EU).

6.4. Effects. If you withdraw, we refund any payments (except return shipping) within 14 days using the same method.


7. Commercial Warranty & Statutory Guarantee

7.1. BOTSMIT Warranty – 6 months

  • Covers parts replaced and labour defects.
  • Remedy: free re-repair or replacement; if impossible, refund of repair price.

7.2. Exclusions:

  • Water/chemical damage, misuse, unauthorised modification
  • Consumables (brushes, filters, mop pads)
  • Defects unrelated to our repair

7.3. Legal guarantee. Consumers retain a 2-year legal guarantee under Latvian Consumer Rights Act; entrepreneurs 1 year (§ Latvian CL Art 1620).

7.4. Claim procedure. Notify info@botsmit.com within 7 days of noticing the defect; ship device with warranty seals intact.


8. Liability Limitations

8.1. Unlimited liability for intent, gross negligence, death/injury, fraud, and under the Product Liability Directive.

8.2. For simple negligence of cardinal duties, liability is limited to foreseeable, typical damages, capped at the Device’s replacement value.

8.3. BOTSMIT is not liable for indirect losses (data, profit, downtime) unless mandatory law dictates.

8.4. These limits also apply to employees and subcontractors.


9. Data Protection & Confidentiality

Processing of personal data is governed by our Privacy Policy (https://botsmit.com/privacy) in compliance with GDPR. We erase customer data on request unless retention is required by law.


10. Unclaimed / Abandoned Devices

10.1. Notification. When repair is complete we notify you to pay and arrange return.

10.2. Storage fees. After 30 days of non-collection, we charge €1 per calendar day storage.

10.3. Disposal. Devices left unclaimed for 90 days are deemed abandoned. We may recycle, sell, or dispose of them to recover costs, after a final 14-day notice.


11. Retention of Title

Replaced parts remain BOTSMIT’s property until full payment is received.


12. Governing Law, Jurisdiction & ODR

12.1. Contracts are governed by Latvian law, excluding CISG.

12.2. Consumers may rely on mandatory protections of their habitual residence (Art 6(2) Rome I).

12.3. Court venue: Riga City Vidzeme District Court for business disputes; consumer disputes per Regulation 1215/2012.

13. Amendments

We may revise these T&C for legal or operational reasons. New versions apply to future orders; ongoing repairs remain under the version accepted when ordered, unless you agree otherwise.
